Information about our luxury senior resort accommodation agreements and policies

1. General Terms

These Terms of Service govern the legal relationship between SeniorResortUp and our residents for all luxury senior living and hospitality services. By utilizing our resort accommodations, you agree to these terms and conditions.

Scope: These terms apply to all services provided by SeniorResortUp, including luxury accommodation, dining services, wellness programs, concierge services, and related hospitality support services. Any deviations from these terms must be agreed upon in writing.

2. Service Scope

SeniorResortUp provides comprehensive luxury senior living services for distinguished individuals seeking premium retirement accommodation. Our service range includes:

  • Luxury Accommodation: Elegant suites with mountain views, private balconies, and premium furnishings
  • Fine Dining Services: Gourmet meals, custom meal planning, and dietary accommodation
  • Wellness Programs: Spa services, fitness programs, and alpine wellness activities
  • Concierge Services: Personal assistance, activity coordination, and lifestyle support
  • Medical Support: Health monitoring, medication assistance, and emergency response
  • Cultural Activities: Social events, cultural excursions, and recreational programs

The specific scope of services will be determined in individual residence agreements. Additional services will be arranged and billed separately.

3. Resident Obligations

For proper delivery of our resort services, our residents and their families are required to:

  • Complete Personal Information: Provide all relevant medical history and accommodation preferences
  • Resort Compliance: Adhere to resort policies and community guidelines
  • Accurate Information: All information must be correct and complete
  • Cooperation: Active participation in residence planning and service updates
  • Timely Payment: Settlement of invoices within agreed payment terms
  • Emergency Contacts: Provide current emergency contact information and healthcare provider details

Incomplete or inaccurate personal information may result in additional accommodation assessments that will be charged to the resident.

4. Fees and Payment Terms

Accommodation fees are based on suite type and service level according to individual residence agreements.

  • Monthly Rates: Classic Suite CHF 8,500/month, Premium Suite CHF 12,500/month, Deluxe Suite CHF 18,500/month
  • Additional Services: Personal care assistance, private dining, and VIP wellness services billed separately
  • Payment Terms: Monthly fees due in advance on the 1st of each month
  • Late Fees: 1.5% per month on overdue balances
  • Additional Costs: Excursions, specialty medical services, and private transportation billed separately

5. Liability and Warranty

SeniorResortUp provides all services with the utmost care and according to recognized principles of Swiss hospitality excellence.

Liability Limitation: Liability is limited to gross negligence and willful misconduct. The amount of liability is limited to three times the annual accommodation fees, but not exceeding CHF 150,000.

Warranty: Defective services will be corrected at no charge if they are due to SeniorResortUp's fault. Further claims are excluded.

6. Confidentiality and Personal Information

SeniorResortUp commits to strict confidentiality of all resident personal information:

  • Professional Confidentiality: All employees are bound to personal information confidentiality
  • Personal Data Protection: Personal information handled according to Swiss privacy laws
  • Data Security: Technical and organizational measures to protect personal data
  • Record Retention: Personal records maintained according to legal requirements (minimum 7 years)

7. Termination and Residence Ending

Residence relationships may be terminated by either party with proper notice:

  • Notice Period: 30 days written notice for ongoing residence contracts
  • Immediate Termination: Possible for important cause or safety concerns
  • Residence Transition: Assistance with accommodation transfer after full payment of all invoices
  • Record Retention: Personal records retained for 7 years, then destroyed

8. Final Provisions

Applicable Law: These terms are governed by the laws of Switzerland.

Jurisdiction: Exclusive jurisdiction is Interlaken, Switzerland.

Amendments: Changes to these terms require written form. If individual provisions become invalid, the remainder of the contract remains valid.

Effective Date: These terms take effect on January 1, 2025, and replace all previous versions.

9. Refund Policy

At SeniorResortUp, we understand that circumstances may require changes to accommodation arrangements. Our refund policy ensures fairness while maintaining the high standards of our luxury senior resort:

Monthly Accommodation Refunds:

  • Cancellation with 60+ days notice: Full refund of prepaid accommodation fees minus a 5% administrative fee
  • Cancellation with 30-59 days notice: 90% refund of prepaid accommodation fees
  • Cancellation with 14-29 days notice: 75% refund of prepaid accommodation fees
  • Cancellation with 7-13 days notice: 50% refund of prepaid accommodation fees
  • Cancellation with less than 7 days notice: 25% refund of prepaid accommodation fees

Special Circumstances: In cases of documented medical emergencies, family emergencies, or other extraordinary circumstances, special consideration may be given for partial or full refunds at management discretion. All refund requests must be submitted in writing with appropriate documentation.
